1. Property owner

Licensed holiday apartment registered with the Valencian Community Tourism Registry under number VT-454572-A, in accordance with Decree 10/2021.

2. Nature of the agreement

These terms govern the temporary use of Emilia's Cabin for holiday or leisure purposes. Each confirmed booking constitutes a short-term rental agreement between the owner and the guest, subject to Spanish law and the applicable Valencian Community tourism regulations.

Completing a booking through this website implies full acceptance of these terms.

3. Booking and confirmation process

  1. The guest selects dates, enters their details and pays the full amount by credit or debit card via Stripe Payments Europe Ltd.
  2. Availability is checked in real time. If the dates become unavailable after the payment process has started, the full amount is refunded automatically.
  3. Once payment is complete, the guest will receive a confirmation email with all booking details. The booking is confirmed at that point.
  4. The minimum stay is 2 nights.

4. Price and payment

  • The price includes accommodation, end-of-stay cleaning and applicable VAT. There are no hidden charges.
  • The full amount is charged at the time of booking.
  • Payment data is handled exclusively by Stripe and is never stored on the property's servers.
  • The local tourist tax is not applicable in Guardamar del Segura as of the date these terms were last updated.

5. Cancellation policy

Free cancellation up to 14 days before arrival.

  • Cancellations made more than 14 days before the check-in date will receive a full refund.
  • Cancellations within 14 days of arrival are non-refundable, except in duly evidenced cases of force majeure (serious illness, death of an immediate family member, or equivalent circumstances).
  • In the event of a no-show without prior notice, the full amount is forfeited.
  • To cancel, contact the owner by email or WhatsApp. Eligible refunds are processed to the original payment method within 5 to 10 business days.

6. Date changes

Date changes are subject to availability and must be requested at least 14 days before the original check-in date. Contact the owner by WhatsApp or email. The owner will endeavour to accommodate requests but is under no obligation to accept them.

7. Check-in and check-out

  • Check-in: from 4:00 PM.
  • Check-out: by 11:00 AM.
  • Check-in is in person. All guests must present their ID or passport as required under Spanish traveller registration regulations (Royal Decree 933/2021).
  • Early check-in or late check-out: please enquire in advance via WhatsApp. Requests will be accommodated where operationally possible.

8. Occupancy and permitted use

  • Maximum occupancy is as stated on the licence. No additional guests beyond those declared in the booking are permitted without prior written approval.
  • The apartment is let exclusively for holiday and leisure use by the persons named in the booking. Sub-letting and commercial use are strictly prohibited.

9. House rules

  • No smoking inside the apartment.
  • No pets unless agreed in writing beforehand.
  • No parties, large gatherings or events.
  • Quiet hours: 10:00 PM to 8:00 AM, in respect of other residents in the building.
  • Guests agree to use the facilities, furniture and appliances responsibly.

10. Guest liability for damages

Guests are liable for any damage or deterioration caused to the apartment, furniture or equipment during their stay through negligent or improper use. In the event of damage, the owner will notify the guest of the repair or replacement cost within 48 hours of check-out and may pursue recovery by the appropriate legal means.

11. Owner's limitation of liability

The owner shall not be liable for damage caused by force majeure (utility outages, extreme weather, acts of third parties, etc.) nor for the loss, theft or damage of guests' personal belongings in the apartment.

12. Governing law and jurisdiction

This agreement is governed by Spanish law and, where applicable, the tourism regulations of the Valencian Community (Decree 10/2021). Any dispute shall be submitted to the courts of Alicante, with both parties waiving any other jurisdiction that may apply.
